Terms of Service

By accessing or using ATS Resume AI (“Service”), operated at atsresumeai.com, you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

ATS Resume AI is an AI-powered tool that analyzes resumes against job descriptions, generates optimized resumes, and creates tailored cover letters. The Service uses third-party AI models (OpenAI) to process your content.

To use the Service, you must create an account using Google or GitHub OAuth. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must provide accurate information and promptly update any changes.

4.1 Free Tier

Every account receives 3 AI generations at no cost. These are one-time and do not renew.

4.2 Paid Subscriptions

Paid plans (Monthly and Yearly) are billed through Paddle, our Merchant of Record. By subscribing, you authorize Paddle to charge your payment method on a recurring basis. Prices are listed on the Pricing page and may change with 30 days' notice.

4.3 Top-Up Credits

Paid subscribers may purchase one-time credit top-ups. Top-up credits never expire but are non-refundable.

4.4 Cancellation & Refunds

You may cancel your subscription at any time from your Account page. Upon cancellation, you retain access until the end of your current billing period. Refunds for subscriptions are handled by Paddle in accordance with their refund policy. One-time top-up purchases are non-refundable.

Each plan includes a monthly generation allowance (Free: 3 total, Monthly: 30/month, Yearly: 60/month). These limits exist to ensure fair access for all users. Automated or programmatic access to the Service (bots, scripts, scraping) is prohibited. We reserve the right to suspend accounts that abuse the Service.

6.1 Ownership

You retain all rights to the content you upload (resumes, job descriptions) and the content generated for you (optimized resumes, cover letters). We do not claim ownership of your content.

6.2 License

By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the Service (e.g., sending resume text to OpenAI for analysis). We do not use your content for training AI models or for any purpose beyond delivering the Service.

6.3 Responsibility

You are solely responsible for the accuracy of the content you upload and the content you submit to employers. AI-generated suggestions are recommendations only — always review and verify before sending.

You agree not to:

• Use the Service for any unlawful purpose.
• Upload content that is fraudulent, misleading, or violates third-party rights.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Use automated tools, bots, or scripts to access the Service.
• Circumvent rate limits, usage caps, or authentication mechanisms.
• Resell, redistribute, or sublicense access to the Service without written permission.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR SUITABLE FOR ANY PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ATS RESUME AI AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

You agree to indemnify and hold harmless ATS Resume AI, its operators, and affiliates from any claims, losses, or damages (including reasonable attorney fees) arising from your use of the Service, your content, or your violation of these Terms.

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the “Last updated” date on this page. Your continued use of the Service after modifications constitutes acceptance of the updated Terms.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the Service operator resides, without regard to conflict of law principles.
